Agreement

These terms govern your use of the Foisr website and any lead generation or appointment setting services we provide. By using the site or engaging us, you agree to them. [REVIEW: confirm the legal entity customers contract with and the effective date.]

Our services

Foisr builds and runs outbound and demand generation systems — cold email, LinkedIn outreach, paid ads and content demand generation — and books qualified sales calls on your calendar. Scope, channels and deliverables are set out in your proposal or agreement.

Fees and payment

Fees are quoted in USD or CAD depending on your location and are confirmed in writing before work begins. Unless your agreement says otherwise, monthly fees are invoiced in advance and setup fees are invoiced at kickoff. Performance guarantee

Before launch we agree a monthly target for qualified sales calls. If we miss that target in a given month, you don't pay our monthly performance fee for that month. A qualified call means a decision-maker at a company matching the agreed ideal customer profile who accepts a meeting about your offer. Your responsibilities

You agree to give us accurate information about your offer and audience, to review and approve messaging promptly, to be available for the meetings we book, and to have the right to promote the products and services we write about.

Compliance

We run campaigns in line with CASL in Canada and CAN-SPAM in the United States, including identification requirements and prompt opt-out handling. You agree not to ask us to run campaigns that break these laws or the rules of any platform we use.

Intellectual property

You keep ownership of your brand, content and customer data. We keep ownership of our methods, templates, lists and internal tooling. Work we create for you under an engagement may be used by you for your own business, and we may keep a copy for our records. [REVIEW: confirm the intended ownership and licence terms.]

Confidentiality

Each of us will keep the other's non-public information confidential and use it only to deliver the services.

Results beyond the agreed target

We can't control your sales conversations, pricing or follow-up, so we don't guarantee revenue, closed deals or return on investment. Our performance commitment is limited to the meeting target set out in your agreement. [REVIEW: confirm this wording matches your contract.]

Limitation of liability
